1. INTRODUCTION AND ACCEPTANCE

1.1. Welcome to Resume Kendra, a premier online job marketplace platform established and operated as a joint venture by RADHEJU & SONS, having its registered office at Sanjeet Naka, Mandsaur - 458001, Madhya Pradesh, India. These Terms and Conditions constitute a legally binding agreement between you and Resume Kendra governing your use of our platform and services.

1.2. By accessing or using our website at https://www.resumekendra.info/ , registering for an account, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must immediately cease using our platform.

These Terms and Conditions apply to all users of our platform, including but not limited to Candidates seeking employment, Employers posting job opportunities, and Branch Partners representing Resume Kendra in various cities. Each user category has specific obligations and rights detailed throughout this document.

1.4. We reserve the right to modify these Terms and Conditions at any time, with changes becoming effective immediately upon posting to our website. Your continued use of the platform following any changes constitutes your acceptance of the modified terms.

1.5. These Terms and Conditions are supplemented by our Privacy Policy, which explains how we collect, use, and protect your personal information. Both documents should be read together for a complete understanding of your rights and obligations.

2. DEFINITIONS AND INTERPRETATION

2.1. "Platform" means the Resume Kendra website accessible at https://www.resumekendra.info/ , including all associated sub-domains, mobile applications, and digital services offered by RADHEJU & SONS.

2.2. "We," "Us," "Our" refers to Resume Kendra, a joint venture brand owned and operated by RADHEJU & SONS, located at Sanjeet Naka, Mandsaur.

2.3. "You," "Your," "User" means any individual or entity accessing or using the Platform, including Candidates, Employers, and Branch Partners.

2.4. "Candidate" means an individual who registers on the Platform to search for employment opportunities, create a professional profile, build resumes, and apply for jobs posted by Employers.

2.5. "Employer" means a company, organization, or individual recruiter who registers on the Platform to post job vacancies, search for potential employees, and manage the recruitment process.

2.6. "Branch Partner" means an individual or entity authorized by Resume Kendra to represent the brand in specific cities, promote the platform, onboard local companies and candidates, and perform related activities as outlined in Section 7.

2.7. "Fee" means any charge levied by Resume Kendra for accessing specific features or services on the Platform, including but not limited to contact information access and premium services.

2.8. "Content" means all information, data, text, images, videos, resumes, job postings, and other materials uploaded, posted, or shared on the Platform by Users.

3. USER CATEGORIES AND ELIGIBILITY

3.1. Resume Kendra recognizes three distinct user categories: Candidates (job seekers), Employers (companies and recruiters), and Branch Partners (authorized representatives). Each category has specific registration requirements and privileges.

3.2. To be eligible to use our Platform, you must be at least 18 years of age or the age of majority in your jurisdiction. Users under 18 are strictly prohibited from registering or using our services.

3.3. By registering as a Candidate, you represent that all information you provide about your qualifications, experience, and personal details is true, accurate, and complete to the best of your knowledge.

3.4. By registering as an Employer, you represent that you have the legal authority to bind your organization to these Terms and that all information about your company is accurate and current.

3.5. Branch Partners must enter into a separate agreement with Resume Kendra and meet specific criteria established by RADHEJU & SONS, including background verification and execution of a formal partnership agreement.

4. ACCOUNT REGISTRATION AND SECURITY

4.1. To access most features of our Platform, you must register for an account by providing a valid email address, creating a username and password, and completing the required profile information for your user category.

4.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Never share your password with anyone.

4.3. You agree to notify us immediately at info@resumekendra.info of any unauthorized use of your account or any other security breach. We are not liable for any loss or damage arising from your failure to protect your account.

4.4. We reserve the right to refuse registration, suspend accounts, or terminate access to any user who violates these Terms or provides false, inaccurate, or misleading information during registration.

4.5. Each user may maintain only one active account unless explicitly authorized by Resume Kendra in writing. Multiple accounts for the same individual or entity are prohibited.

5. CANDIDATE TERMS AND CONDITIONS

5.1. As a Candidate, you may create a professional profile, build and upload resumes, search for job opportunities, and apply to positions posted by Employers on the Platform.

5.2. You are solely responsible for the accuracy, truthfulness, and completeness of all information you provide in your profile, resume, and job applications. Misrepresentation may result in account termination.

5.3. You acknowledge that your profile information, excluding contact details, will be visible to registered Employers on the Platform to facilitate the job matching process.

5.4. You agree to use the Platform only for legitimate job-seeking purposes and not to submit fraudulent applications, spam Employers, or engage in any deceptive practices.

5.5. When you apply for a position, your information will be shared with the respective Employer in accordance with our Privacy Policy and these Terms.

6. EMPLOYER TERMS AND CONDITIONS

6.1. As an Employer, you may create a company profile, post job vacancies, search for Candidates, and manage your recruitment activities through the Platform.

6.2. You are solely responsible for the accuracy and legality of all job postings you create, including compliance with applicable employment laws, non-discrimination requirements, and truthful representation of positions.

6.3. You acknowledge that your company profile and job postings will be visible to registered Candidates on the Platform to attract potential applicants.

6.4. You agree to use Candidate information obtained through the Platform solely for legitimate recruitment purposes and not for unsolicited marketing, harassment, or any purpose other than evaluating candidates for employment.

6.5. You are responsible for all recruitment activities conducted through your account, including communications with Candidates, interview scheduling, and hiring decisions.

7. BRANCH PARTNER TERMS AND CONDITIONS

7.1. Branch Partners are authorized representatives of Resume Kendra operating in specific cities to promote the platform, onboard local companies and candidates, and expand our reach across India.

7.2. Branch Partners must execute a formal partnership agreement with RADHEJU & SONS, located at Sanjeet Naka, Mandsaur, before commencing any activities on behalf of Resume Kendra.

7.3. Branch Partners are responsible for promoting Resume Kendra in their assigned territory, including conducting local marketing, building relationships with companies, and encouraging candidate registrations.

7.4. Branch Partners shall accurately represent Resume Kendra's services, fees, and policies to all prospective users and shall not make any false or misleading claims about the Platform.

7.5. Branch Partners may earn commissions or incentives based on successful company onboardings, candidate registrations, or other performance metrics as detailed in their individual partnership agreements.

7.6. Branch Partners must maintain professional conduct at all times and shall not engage in any activity that could harm the reputation of Resume Kendra or RADHEJU & SONS.

7.7. All marketing materials and communications created by Branch Partners must be pre-approved by Resume Kendra's central office at Mandsaur before public distribution.

7.8. Branch Partners are independent contractors and not employees of RADHEJU & SONS. They are responsible for their own taxes, insurance, and compliance with local laws.

7.9. Branch Partners shall keep all confidential information about Resume Kendra's operations, strategies, and user data strictly confidential, both during and after the partnership term.

7.10. The partnership agreement may be terminated by either party with written notice as specified in the individual agreement, or immediately for breach of these Terms or unethical conduct.

7.11. Upon termination, Branch Partners must immediately cease representing Resume Kendra and return or destroy all confidential materials in their possession.

7.12. Branch Partners are prohibited from creating competing platforms or representing competing services during the term of their partnership with Resume Kendra.

7.13. Disputes between Branch Partners and Resume Kendra shall be resolved through good-faith negotiations, and if unsuccessful, through arbitration in Mandsaur, Madhya Pradesh.

7.14. Branch Partners acknowledge that their relationship with Resume Kendra is non-exclusive unless otherwise specified in their individual agreement.

7.15. Branch Partners must comply with all applicable laws and regulations in their territory, including data protection laws when handling user information.

8. PLATFORM SERVICES AND FEATURES

8.1. Resume Kendra provides a comprehensive job marketplace where Candidates can create professional profiles and Employers can post job opportunities, enabling meaningful connections between talent and organizations.

8.2. Candidates may build and store multiple resumes, receive job recommendations based on their profiles, and track their application history through their account dashboard.

8.3. Employers may manage job postings, search for candidates using various filters, shortlist promising applicants, and communicate with potential hires through the Platform.

8.4. Basic profile information is mutually visible between Candidates and Employers, while contact information access requires payment of the applicable Fee as described in Section 10.

8.5. We strive to maintain high availability of our Platform but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience technical issues affecting availability.

9. FEE STRUCTURE AND PAYMENTS

9.1. Registration and basic profile creation on Resume Kendra is free for all Users. Certain premium features, including access to full contact information, require payment of applicable Fees.

9.2. All Fees are clearly displayed at the point of transaction and are non-refundable except as expressly provided in these Terms or required by applicable law.

9.3. Payments may be processed through third-party payment gateways. By making a payment, you agree to the terms of those payment processors and represent that you have the legal right to use the chosen payment method.

9.4. Fees are subject to change at our discretion, with changes becoming effective for future transactions upon posting to the Platform.

9.5. We reserve the right to offer promotional discounts or special pricing from time to time, which may have additional terms and conditions.

9.6. Branch Partners may have separate fee structures, commission arrangements, or incentive programs as detailed in their individual partnership agreements.

10. CONTACT INFORMATION ACCESS POLICY

10.1. Basic professional information including skills, experience, company name, and job titles is mutually visible to all registered Users without charge to facilitate initial discovery and vetting.

10.2. Full Contact Information, defined as personal email addresses, official contact emails, personal mobile numbers, and official phone numbers, is accessible only upon payment of the applicable Fee.

10.3. The Fee applies equally to Candidates wishing to contact Employers and Employers wishing to contact Candidates, ensuring fairness across both user groups.

10.4. The Fee is a platform charge that helps maintain our infrastructure, deter spam, and ensure that only genuine users make contact through the Platform.

10.5. Once the Fee is paid, the requesting User may view the unmasked Contact Information of the other party for the purpose of legitimate recruitment or job-seeking communication.

10.6. Users obtaining Contact Information through Fee payment agree to use such information solely for lawful recruitment or job-seeking purposes and not for unsolicited marketing, harassment, or any other unauthorized use.

11. CONTENT AND CONDUCT GUIDELINES

11.1. You are solely responsible for all Content you post on the Platform, including resumes, job postings, profile information, and communications with other Users.

11.2. You agree not to post any Content that is false, misleading, defamatory, harassing, discriminatory, obscene, or otherwise objectionable or in violation of any applicable laws.

11.3. You shall not use the Platform to transmit any viruses, malware, or other harmful code, or to engage in any activity that could damage, disable, or impair our systems.

11.4. You shall not attempt to gain unauthorized access to any accounts, systems, or data related to the Platform, or to bypass any security measures we have in place.

11.5. You shall not scrape, copy, or reproduce any Content from the Platform without our express written permission, except for your own legitimate use as intended by the Platform.

11.6. You shall not use the Platform to send spam, chain letters, junk mail, or any unsolicited communications to other Users.

11.7. We reserve the right to review, moderate, or remove any Content that violates these Terms or that we deem inappropriate, without prior notice.

11.8. Repeat violators of our content guidelines may have their accounts suspended or terminated permanently.

12. INTELLECTUAL PROPERTY RIGHTS

12.1. The Platform, including its design, layout, graphics, logos, software, and all content not uploaded by Users, is the exclusive property of RADHEJU & SONS and is protected by Indian and international intellectual property laws.

12.2. "Resume Kendra" and the Resume Kendra logo are trademarks of RADHEJU & SONS. You may not use these trademarks without our prior written permission.

12.3. By posting Content on the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such Content solely for the purpose of operating and providing our services.

12.4. You retain all ownership rights to your Content, but you acknowledge that other Users may view and interact with your Content as intended by the Platform.

12.5. You represent and warrant that you have all necessary rights to the Content you post and that such Content does not infringe any third-party intellectual property rights.

13. PRIVACY AND DATA PROTECTION

13.1. Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

13.2. By using the Platform, you consent to the collection and processing of your information as described in the Privacy Policy.

13.3. You acknowledge that information you make visible to other Users through your profile may be viewed, saved, or used by those Users in accordance with these Terms.

13.4. We implement reasonable security measures to protect your information, but we cannot guarantee absolute security given the nature of internet communications.

13.5. You are responsible for protecting your own information and for the information you choose to share with other Users.

14. THIRD-PARTY LINKS AND SERVICES

14.2. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

14.4. The inclusion of any link does not imply endorsement by Resume Kendra of the linked site or service.

15. TERMINATION AND SUSPENSION

15.1. You may terminate your account at any time by following the account deletion procedures in your settings or by contacting us at info@resumekendra.info.

15.2. We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, fraudulent activity, or at our discretion.

15.3. Upon termination, your right to access and use the Platform will immediately cease. Certain provisions of these Terms, including those relating to intellectual property, limitation of liability, and dispute resolution, shall survive termination.

15.4. We are not liable to you or any third party for any termination of your account or access to the Platform.

15.5. If you believe your account was terminated in error, you may contact us to appeal the decision.

16. LIMITATION OF LIABILITY

16.1. To the maximum extent permitted by applicable law, Resume Kendra and RADHEJU & SONS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.

16.2. We do not guarantee that Candidates will find employment or that Employers will find suitable candidates through the Platform. We are a marketplace facilitating connections, not a guarantor of outcomes.

16.3. We are not responsible for the conduct of any User, whether online or offline. You assume all risk when interacting with other Users.

16.4. Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid to us, if any, during the twelve months preceding the claim.

16.5. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

17. INDEMNIFICATION

17.1. You agree to indemnify, defend, and hold harmless Resume Kendra, RADHEJU & SONS, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising out of or relating to:

17.2. Your use of the Platform or any Content you post;

17.3. Your violation of these Terms or any applicable law or regulation;

17.4. Your violation of any rights of another User or third party;

17.5. Any dispute between you and another User.

17.6. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.

18. DISPUTE RESOLUTION AND GOVERNING LAW

18.1. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

18.2. Any dispute arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiations between the parties.

18.3. If a dispute cannot be resolved through negotiations within 30 days, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

18.4. The arbitration shall be conducted in Mandsaur, Madhya Pradesh, in the English language, by a sole arbitrator appointed by mutual agreement of the parties.

18.5. The arbitration award shall be final and binding on both parties, and judgment may be entered in any court having jurisdiction.

18.6. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from the courts in Mandsaur, Madhya Pradesh to protect its intellectual property rights or confidential information.

18.7. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Mandsaur, Madhya Pradesh, and you consent to the jurisdiction of such courts.

19. MODIFICATIONS TO TERMS

19.1. We reserve the right to modify these Terms at any time, with changes becoming effective immediately upon posting to the Platform.

19.2. We will use reasonable efforts to notify you of material changes, such as by email or through a notice on our website, but it is your responsibility to review these Terms periodically.

19.3. Your continued use of the Platform after any changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must cease using the Platform.

19.4. Certain provisions of these Terms may be supplemented or modified by additional terms for specific features or services, which will be presented to you at the time of use.

20. MISCELLANEOUS PROVISIONS

20.4. Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms freely in connection with a merger, acquisition, or sale of assets.

20.6. Force Majeure: We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or network infrastructure failures.

20.7. Relationship: No agency, partnership, joint venture, or employment relationship is created between you and Resume Kendra as a result of these Terms or your use of the Platform, except for Branch Partners who have executed a separate partnership agreement.

20.8. Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.

20.9. Language: These Terms may be translated into other languages for convenience. In the event of any inconsistency between the English version and a translated version, the English version shall prevail.
