1. INTRODUCTION TO AI SERVICES

1.1. Resume Kendra is pleased to introduce Artificial Intelligence (AI) powered services on our platform to enhance the experience of our users, including Candidates, Employers, and Branch Partners. These AI services are designed to make job searching, resume building, candidate matching, and recruitment more efficient and effective.

1.2. Located at Sanjeet Naka, Mandsaur, RADHEJU & SONS operates these AI services as part of our commitment to leveraging cutting-edge technology to transform the job marketplace in India and provide innovative solutions to our users.

1.3. This User Agreement for AI Services governs your use of all AI-powered features, tools, and services available on the Resume Kendra platform. It supplements our general Terms and Conditions, Privacy Policy, and other policies.

1.4. By using any AI service on our platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part, you should not use the AI services.

1.5. The AI services are continuously evolving, and we may introduce new features or modify existing ones. This Agreement will apply to all such changes.

2. DEFINITIONS AND INTERPRETATION

2.1. "AI" or "Artificial Intelligence" means machine learning algorithms, natural language processing systems, and other computational technologies used to provide automated services on the platform.

2.2. "AI Services" means all features and tools on the platform that utilize AI, including but not limited to AI resume builder, AI job matching, AI candidate screening, and AI recommendations.

2.3. "AI-Generated Content" means any text, suggestions, analysis, recommendations, or other output produced by AI algorithms based on user inputs and platform data.

2.4. "Training Data" means the information used to train, improve, and refine our AI models, which may include anonymized user data and content.

2.5. "User Inputs" means the information, preferences, and content you provide to the AI services, such as resume details, job preferences, or screening criteria.

2.6. "Output" means the results, recommendations, or content generated by AI services based on your inputs.

2.7. "AI Resume Builder" means the tool that helps Candidates create, format, and optimize professional resumes using AI assistance.

2.8. "AI Job Matching" means the system that recommends relevant job opportunities to Candidates and suitable candidates to Employers based on AI analysis.

2.9. "AI Screening" means the tool that helps Employers filter and evaluate Candidate applications using AI-powered analysis.

3. ACCEPTANCE OF TERMS

3.1. By accessing or using any AI service on the Resume Kendra platform, you agree to be bound by this User Agreement for AI Services, our general Terms and Conditions, Privacy Policy, and all other applicable policies.

3.2. If you are using AI services on behalf of an organization (as an Employer or Branch Partner), you represent and warrant that you have authority to bind that organization to this Agreement.

3.3. Your use of AI services constitutes your acknowledgment that AI systems may not be perfect and that you will not rely solely on AI outputs without applying your own judgment.

3.4. We recommend that all users read this Agreement carefully before using any AI service. If you have questions, please contact us at ai@resumekendra.info.

3.5. We may update this Agreement from time to time, and your continued use of AI services constitutes acceptance of the updated terms.

4. SCOPE OF AI SERVICES

4.1. Resume Kendra offers various AI-powered services to enhance the job marketplace experience. These services are available to different user categories as described below.

4.2. For Candidates: AI Resume Builder, AI Job Matching, AI Skill Recommendations, AI Career Suggestions, AI Application Tips, and AI Profile Enhancement.

4.3. For Employers: AI Candidate Screening, AI Job Description Generator, AI Candidate Matching, AI Skill Gap Analysis, and AI Recruitment Insights.

4.4. For Branch Partners: AI Lead Scoring, AI Territory Insights, AI Candidate-Employer Matching Assistance, and AI Performance Analytics.

4.5. The specific AI services available to you may vary based on your user type, account status, location, and any subscriptions or purchases.

4.6. We may add, modify, or remove AI services at any time without prior notice. The availability of AI services may also vary based on technical or operational factors.

4.7. Some AI services may be provided free of charge, while others may require payment of applicable fees as described on the platform.

5. ELIGIBILITY AND ACCOUNT REQUIREMENTS

5.1. To use AI services, you must have a registered account on Resume Kendra and be in good standing with no violations of our Terms and Conditions.

5.2. You must be at least 18 years of age to use AI services. We do not permit minors to use any AI features on the platform.

5.3. Your account must be verified with a valid email address and phone number to access certain AI services.

5.4. For premium AI services, you may need to have an active subscription or sufficient Wallet balance to pay applicable fees.

5.5. Branch Partners must have an active partnership agreement to access AI services designed for partners.

5.6. We reserve the right to restrict access to AI services for any user who violates this Agreement or our other policies.

5.7. You are responsible for maintaining the security of your account and for all activities conducted through your account, including AI service usage.

6. DATA COLLECTION AND USAGE FOR AI

6.1. To provide AI services, we collect and process various types of information, including your profile data, resume content, job preferences, search history, and interaction data.

6.2. By using AI services, you consent to the collection and processing of your data for the purpose of providing, improving, and personalizing AI features.

6.3. We may use anonymized and aggregated user data to train and improve our AI models. This data cannot be traced back to individual users.

6.4. Your specific inputs to AI services (such as resume details or screening criteria) are used to generate outputs for you and are not shared with other users.

6.5. We implement reasonable security measures to protect your data used in AI processing, but no system is completely secure.

6.6. You retain ownership of your content, but you grant us a license to use it for AI processing as described in our Privacy Policy.

6.7. For more details on how we handle your data, please refer to our Privacy Policy, which is incorporated into this Agreement by reference.

7. AI-GENERATED CONTENT

7.1. AI-Generated Content on Resume Kendra is created by algorithms based on patterns learned from large datasets and your specific inputs.

7.2. AI-Generated Content is provided for informational and assistance purposes only and should not be considered professional advice.

7.3. You acknowledge that AI-Generated Content may not always be accurate, complete, appropriate, or suitable for your specific situation.

7.4. You are solely responsible for reviewing, editing, and approving any AI-Generated Content before using it, such as resumes created by AI or job descriptions generated by AI.

7.5. AI-Generated Content may unintentionally contain biases, errors, or inappropriate suggestions. You should apply your own judgment and expertise.

7.6. We do not claim ownership of AI-Generated Content created based on your inputs. You retain ownership of the final content you approve and use.

7.7. However, you grant us a license to use anonymized AI-Generated Content for improving our AI services.

7.8. AI-Generated Content should not be used as the sole basis for important decisions such as hiring, career changes, or investments.

8. RESUME BUILDING AI SERVICES

8.1. The AI Resume Builder helps Candidates create professional resumes by providing templates, formatting suggestions, content recommendations, and language enhancements.

8.2. When using the AI Resume Builder, you may provide information about your education, work experience, skills, and achievements. The AI will suggest ways to present this information effectively.

8.3. AI suggestions for resume content are based on patterns from successful resumes but do not guarantee that your resume will lead to job interviews or offers.

8.4. You are responsible for ensuring that all information in your resume is accurate, truthful, and not misleading. AI suggestions should be verified before inclusion.

8.5. The AI may suggest keywords and phrases commonly used in your industry, but you should ensure they accurately reflect your qualifications.

8.6. We do not guarantee that resumes created with AI assistance will pass applicant tracking systems or be favored by employers.

8.7. You should review the final resume carefully for accuracy, grammar, and appropriateness before submitting it to employers.

8.8. The AI Resume Builder is a tool to assist you, not a substitute for your own effort in creating a quality resume.

9. JOB MATCHING AI SERVICES

9.1. AI Job Matching services recommend job opportunities to Candidates based on analysis of their profiles, skills, experience, preferences, and past behavior.

9.2. For Employers, AI services recommend suitable Candidates based on job requirements, desired skills, experience levels, and other criteria.

9.3. AI matching algorithms use complex calculations to determine relevance, but they may not always identify the best matches.

9.4. Recommendations provided by AI are suggestions only and should not be the sole factor in deciding which jobs to apply for or which candidates to consider.

9.5. Candidates should review job descriptions carefully before applying, even if recommended by AI, to ensure the position truly matches their interests and qualifications.

9.6. Employers should review candidate profiles thoroughly before making contact, even if highly recommended by AI.

9.7. The accuracy of AI matching depends on the quality and completeness of information provided by users. Incomplete or inaccurate profiles may lead to poor recommendations.

9.8. We continuously work to improve matching algorithms, but we cannot guarantee that every recommendation will be relevant or appropriate.

10. CANDIDATE SCREENING AI SERVICES

10.1. AI Screening services help Employers evaluate and filter candidate applications by analyzing resumes, cover letters, and profiles against job requirements.

10.2. AI screening may rank candidates, highlight key qualifications, identify potential red flags, and suggest candidates most worthy of further review.

10.3. AI screening is a tool to assist human recruiters, not a replacement for human judgment in the hiring process.

10.4. Employers should not rely solely on AI screening results to make hiring decisions. All candidates should be evaluated fairly through appropriate interview processes.

10.5. AI screening may have limitations in understanding nuanced qualifications, cultural fit, soft skills, or unique candidate attributes.

10.6. We strive to minimize bias in AI screening algorithms, but no AI system is completely free from potential bias.

10.7. Employers are responsible for ensuring their use of AI screening complies with all applicable employment laws and anti-discrimination regulations.

11. AI RECOMMENDATIONS AND SUGGESTIONS

11.8. You are ultimately responsible for the decisions you make based on AI recommendations.

12. ACCURACY OF AI OUTPUTS

12.1. While we strive to ensure the accuracy and reliability of AI outputs, we do not guarantee that AI-generated content, recommendations, or analysis will be error-free, complete, or appropriate.

12.2. AI systems learn from data and may reflect inaccuracies, biases, or limitations present in that data.

12.3. AI outputs should be treated as suggestions and starting points, not as definitive answers or professional advice.

12.4. We are not liable for any inaccuracies in AI outputs or for any decisions you make based on such outputs.

12.5. If you notice persistent errors or inaccuracies in AI outputs, please report them to ai@resumekendra.info to help us improve.

12.6. AI technology is evolving, and we continuously work to enhance accuracy, but perfection cannot be guaranteed.

12.7. Users in regulated industries or professions should exercise particular caution and verify AI outputs against professional standards.

12.8. Time-sensitive information provided by AI should be verified with current sources.

13. USER RESPONSIBILITIES WITH AI

13.1. You are responsible for providing accurate, complete, and truthful information when using AI services. Inaccurate inputs will lead to inaccurate outputs.

13.2. You are responsible for reviewing, verifying, and editing all AI-generated content before using it for any purpose.

13.3. You should not rely solely on AI recommendations for important decisions. Always apply your own judgment and consult appropriate professionals when needed.

13.4. You are responsible for ensuring that your use of AI services complies with all applicable laws and regulations.

13.5. You should not use AI services to create content that is false, misleading, defamatory, discriminatory, or illegal.

13.6. You should respect the intellectual property rights of others when using AI-generated content.

13.7. You are responsible for maintaining backups of any important content created with AI assistance.

13.8. You should report any technical issues, inappropriate AI outputs, or concerns about AI services to our support team.

14. LIMITATIONS OF AI SERVICES

14.1. AI services have inherent limitations and may not understand context, nuance, sarcasm, or complex human emotions.

14.2. AI may not be able to accurately assess soft skills, cultural fit, personality traits, or other subjective qualities important in hiring.

14.3. AI systems may not be up-to-date with the latest industry trends, company information, or market conditions.

14.4. AI may generate plausible-sounding but incorrect or nonsensical information. Always verify important facts.

14.5. AI services may not be available in all languages or may perform poorly in languages other than those they were primarily trained on.

14.6. AI may have difficulty with highly specialized or niche industries where training data is limited.

14.7. AI services may be temporarily unavailable due to maintenance, technical issues, or high demand.

14.8. We do not guarantee that AI services will meet your specific requirements or expectations.

14.9. AI is a tool to augment human capabilities, not to replace human judgment, creativity, or expertise.

15. INTELLECTUAL PROPERTY RIGHTS

15.1. The AI algorithms, models, software, and technology used to provide AI services are the exclusive property of RADHEJU & SONS or its licensors and are protected by intellectual property laws.

15.2. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of any AI systems.

15.3. You may not use AI services to create competing products or services or to extract data for training external AI models.

15.4. You retain ownership of the content you provide to AI services and the final content you create using AI assistance.

15.5. AI-generated content may incorporate patterns learned from training data, and ownership of such content is governed by applicable laws.

15.6. By using AI services, you grant us a non-exclusive, worldwide, royalty-free license to use your inputs and the resulting outputs to improve our AI systems, provided that such use is anonymized.

15.7. You represent that you have all necessary rights to the information you provide to AI services.

16. DATA PRIVACY AND AI TRAINING

16.1. Your privacy is important to us. Our collection and use of your data for AI services is governed by our Privacy Policy.

16.2. We may use anonymized user data to train, test, and improve our AI models. This data is stripped of personally identifiable information.

16.3. You have the right to opt out of having your data used for AI training by contacting us at privacy@resumekendra.info, though this may limit certain AI features.

16.4. We do not sell your personal data to third parties for AI training or any other purpose.

17.5. You should not provide feedback that contains confidential information or trade secrets of third parties.

17.6. We appreciate constructive feedback that helps us make our AI services better for all users.

17.7. Users who provide valuable feedback may be acknowledged in our communications, at our discretion.

18. PROHIBITED USES OF AI

18.1. You may not use AI services for any unlawful purpose or in violation of any applicable laws or regulations.

18.2. You may not use AI services to generate discriminatory, harassing, abusive, or offensive content.

18.3. You may not use AI services to impersonate any person or entity or to misrepresent your identity or qualifications.

18.4. You may not use AI services to generate spam, unsolicited communications, or fraudulent job postings.

18.5. You may not use AI services to reverse engineer, extract data, or scrape information from the platform.

18.6. You may not use AI services to train competing AI models or to create competing platforms.

18.7. You may not use AI services to generate content that infringes on the intellectual property rights of others.

18.8. You may not use AI services to manipulate or deceive other users, including creating fake profiles or fraudulent applications.

18.9. Violation of these prohibited uses may result in immediate termination of your account and legal action.

18.10. We reserve the right to monitor usage patterns to detect and prevent prohibited uses.

19. FEES AND CHARGES FOR AI SERVICES

19.1. Some AI services may be provided free of charge, while others may require payment of applicable fees as displayed on the platform.

19.2. Fees for premium AI services will be clearly communicated before you incur any charge.

19.3. AI service fees may be charged on a per-use basis, subscription basis, or through Wallet deductions as specified.

19.4. All fees are non-refundable except as expressly provided in our refund policy or required by law.

19.5. We reserve the right to change fees for AI services at any time, with changes effective for future usage.

19.6. Free AI services may be converted to paid services at our discretion, with reasonable notice to users.

19.7. You are responsible for all fees incurred through your account, regardless of who actually uses the services.

20. DISCLAIMER OF WARRANTIES

20.1. AI SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

20.2. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.

20.3. WE DO NOT WARRANT THAT AI SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

20.4. WE DO NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE, RELIABLE, COMPLETE, OR APPROPRIATE FOR YOUR SITUATION.

20.5. NO ADVICE OR INFORMATION OBTAINED BY YOU FROM US OR THROUGH AI SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

20.6. YOU ACKNOWLEDGE THAT AI TECHNOLOGY HAS INHERENT LIMITATIONS AND MAY NOT PERFORM AS EXPECTED IN ALL SITUATIONS.

20.7. THE ENTIRE RISK ARISING OUT OF THE USE OF AI SERVICES REMAINS WITH YOU.

21. LIMITATION OF LIABILITY

21.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUME KENDRA, RADHEJU & SONS, AND THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OF AI SERVICES.

21.2. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

21.3. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM AI SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR SUCH SERVICES DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

21.4. WE ARE NOT LIABLE FOR ANY DECISIONS YOU MAKE BASED ON AI-GENERATED CONTENT OR RECOMMENDATIONS.

21.5. WE ARE NOT LIABLE FOR ANY LOSSES ARISING FROM YOUR RELIANCE ON AI OUTPUTS WITHOUT INDEPENDENT VERIFICATION.

21.6. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

21.7. THIS LIMITATION OF LIABILITY IS A FUNDAMENTAL PART OF THE BASIS OF OUR BARGAIN AND REFLECTS A FAIR ALLOCATION OF RISK.

22. INDEMNIFICATION

22.1. You agree to indemnify, defend, and hold harmless Resume Kendra, RADHEJU & SONS, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising out of or relating to:

22.2. Your use of AI services in violation of this Agreement.

22.3. Your violation of any applicable laws or regulations through your use of AI services.

22.4. Any content you create or modify using AI services that infringes on the rights of others.

22.5. Any disputes between you and other users arising from AI-generated content or recommendations.

22.6. Your reliance on AI outputs without appropriate verification or judgment.

22.7. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

22.8. This indemnification obligation survives termination of this Agreement and your account.

23. TERMINATION OF AI SERVICES

23.1. We reserve the right to suspend or terminate your access to AI services at any time for any reason, including but not limited to violation of this Agreement or our other policies.

23.2. You may stop using AI services at any time. No refunds will be provided for prepaid services unless required by law.

23.3. Upon termination, your right to use AI services ceases immediately, and any AI-generated content may no longer be accessible.

23.4. We may discontinue any AI service entirely at our discretion, with reasonable notice to users where feasible.

23.5. Termination does not relieve you of any obligations incurred before termination, including payment obligations.

23.6. Provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

24. MODIFICATIONS TO AI SERVICES

24.1. We are constantly working to improve our AI services and may modify, update, or enhance them at any time without notice.

24.2. We may introduce new AI features, change existing features, or discontinue features as we deem appropriate.

24.3. We will use reasonable efforts to notify users of significant changes that may affect their use of AI services.

24.4. Your continued use of AI services after modifications constitutes acceptance of the modified services and any related terms.

24.5. We are not liable for any losses arising from modifications to AI services.

24.6. If you do not agree with modifications, you should stop using the affected AI services.

25. GOVERNING LAW

25.1. This User Agreement for AI Services shall be governed by and construed in accordance with the laws of India.

25.2. Any disputes arising out of or relating to this Agreement or your use of AI services shall be subject to the exclusive jurisdiction of the courts in Mandsaur, Madhya Pradesh, India.

25.3. The parties agree to attempt to resolve any dispute through good-faith negotiations before resorting to legal action.

25.4. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

25.5. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
